Please read these Terms of Service carefully before using the Service. These Terms, together with the Privacy Policy, Payment & Refund Policy, Minor Use Terms and Community Code of Conduct, form a legally binding agreement between you and us.

If you do not agree to any part of these Terms, do not use the Service or stop using it immediately.

The Service is not directed to children under 13; if you are aged 13–17, you may use the Service only with your parent/guardian’s consent and supervision (see the Minor Use Terms).

1. 定義 / Definitions

在本條款中,除非上下文另有規定:

「我們」/「本公司」指[公司法定名稱](香港註冊),以及其授權運營本服務的相關人員。

「本服務」指我們提供的 Olé Game 及其相關網站、H5頁面、內容、功能及服務(包括但不限於互動、社交、付費內容/虛擬幣、廣告展示、客服支援等)。

「用戶內容」指您在本服務中上載、發布、傳送或以其他方式提供的文字、圖片、音訊、影片、留言、私訊、暱稱、頭像、遊戲內創作等內容。

「虛擬幣/虛擬物品」指可於本服務內購買或獲得,用於兌換/解鎖數位內容或權益的虛擬點數、代幣、道具、權益等。

In these Terms, unless the context otherwise requires:

"We", "us" or "our" means [Company Legal Name] incorporated in Hong Kong, and its authorized personnel operating the Service.

"Service" means Olé Game and its related websites, H5 pages, content, features and services (including without limitation, interactions, social features, paid digital content/virtual currency, advertising display and customer support).

"User Content" means any text, images, audio, video, comments, messages, nicknames, avatars, in-game creations or other content you upload, publish, transmit or otherwise provide on or through the Service.

"Virtual Currency/Virtual Items" means virtual points, tokens, items or entitlements that may be purchased or obtained in the Service and used to redeem/unlock digital content or benefits.

2. 資格、年齡與帳號 / Eligibility, Age and Account

2.1 您須具備依適用法律締結具約束力合同的能力。香港一般以18歲為成年。

2.2 本服務不面向未滿13歲兒童。如您未滿13歲,請勿使用本服務或向我們提供任何個人資料。

2.3 如您為13–17歲,您必須取得父母或法定監護人明確同意並在其監護下使用本服務。若您未滿18歲,監護人亦應監督您的使用時間、互動及付費行為。

2.4 本服務目前可能以「免註冊」或「訪客模式」提供部分功能;如我們提供帳號系統,您應按提示提供必要資料並妥善保管登入憑證。

2.5 您同意我們可要求您選擇或提交年齡段(例如:未滿13歲、13-17歲、18歲或以上等)以提供合適內容、付費及廣告體驗及履行合規義務。

2.6 您不得冒用他人身份或提供虛假資料。若我們合理懷疑您提供的年齡或資料不真實,我們可要求您重新確認,並可限制、暫停或終止您使用本服務。

2.1 You must have the legal capacity to enter into a binding contract under applicable law. In Hong Kong, a person generally attains full age at 18.

2.2 The Service is not directed to children under 13. If you are under 13, do not use the Service or provide any personal data to us.

2.3 If you are aged 13–17, you must obtain your parent/legal guardian’s explicit consent and use the Service under their supervision. If you are under 18, your guardian should also supervise your time spent, interactions and purchases.

2.4 The Service may currently be available in a no-registration or guest mode for certain features; if we provide an account system, you must provide required information as prompted and keep your credentials secure.

2.5 You agree that we may ask you to select or provide an age band (e.g., under 13, 13–17, 18 or above) to deliver appropriate content, payment and advertising experiences and to meet compliance obligations.

2.6 You must not impersonate others or provide false information. If we reasonably suspect your age or information is inaccurate, we may ask you to reconfirm and may restrict, suspend or terminate your access to the Service.

3. 服務內容、內容來源與用戶內容 / Service, Content Sources and User Content

3.1 我們向您提供內容瀏覽、互動、社交、付費解鎖/虛擬幣、推薦及廣告展示等功能。具體以實際提供為準,且我們可不時調整、升級或新增功能。

3.2 本服務內的內容可能由我們、內容供應商、第三方或用戶提供。我們不保證任何第三方內容的準確性、完整性或適用性。

3.3 您應對您發佈的用戶內容負責,並保證您有權提供該等內容,且不侵犯任何第三方權利(包括知識產權、私隱權、人格權等)。

3.4 內容處理:我們可(但無義務)對用戶內容進行審核、移除、限制可見或採取其他處置,以符合適用法律及《社區行為守則》。

3.1 We provide features such as content viewing, interactions, social features, paid unlock/virtual currency, recommendations and advertising display. The actual features available may change, and we may modify, upgrade or add features from time to time.

3.2 Content in the Service may be provided by us, content suppliers, third parties or users. We do not guarantee the accuracy, completeness or suitability of any third-party content.

3.3 You are responsible for your User Content and represent that you have the right to provide it and that it does not infringe any third-party rights (including intellectual property, privacy and personality rights).

3.4 Content moderation: We may (but are not obligated to) review, remove, restrict visibility of, or otherwise take action on User Content to comply with applicable laws and the Community Code of Conduct.

4. 用戶內容授權 / License to User Content

4.1 您保留對您用戶內容擁有的權利。但您授予我們一項全球性、非獨占、免版稅、可轉授權、可再許可的權利,以便在提供、營運、改進、推廣及保護本服務所需範圍內使用、複製、存儲、展示、公開傳播、改編(例如格式轉換、截圖縮略圖)、分發您的用戶內容。

4.2 如您刪除用戶內容或帳號,我們將按《私隱政策》的保留政策處理;但基於技術備份、爭議處理、法律合規或防止違法行為等需要,我們可能在合理期間內保留必要副本。

4.1 You retain rights in your User Content. However, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, store, display, publicly communicate, adapt (e.g., formatting, thumbnails), and distribute your User Content to the extent necessary to provide, operate, improve, promote and protect the Service.

4.2 If you delete User Content or your account, we will handle it in accordance with the retention practices described in the Privacy Policy; however, we may retain necessary copies for a reasonable period for technical backups, dispute resolution, legal compliance, or to prevent unlawful activities.

5. 付費服務、虛擬幣與虛擬物品 / Paid Services, Virtual Currency and Virtual Items

5.1 本服務可提供付費功能(例如:以虛擬幣購買/解鎖內容、購買虛擬物品等)。價格、可用項目及規則以購買頁面或相關提示為準。

5.2 您理解並同意:虛擬幣/虛擬物品並非法定貨幣或有價證券,不能兌換現金(除非適用法律另有強制規定),不得轉讓、贈與或交易。

5.3 付費與退款規則適用《付費與退款政策》。除適用法律另有規定及《付費與退款政策》明確列明外,數位內容/虛擬幣/虛擬物品一般不予退款。

5.4 我們可為防止欺詐、洗錢或違法行為而要求額外驗證或限制交易。

5.1 The Service may offer paid features (e.g., purchasing/unlocking content using virtual currency, purchasing virtual items). Prices, available items and rules are shown on the purchase page or relevant prompts.

5.2 You understand and agree that Virtual Currency/Virtual Items are not legal tender or securities, cannot be redeemed for cash (unless required by applicable law), and are non-transferable and may not be traded or gifted.

5.3 The Payment & Refund Policy applies. Except as required by applicable law and as explicitly stated in the Payment & Refund Policy, digital content/virtual currency/virtual items are generally non-refundable.

5.4 We may require additional verification or impose transaction limits to prevent fraud, money laundering or unlawful activities.

6. 廣告與第三方服務 / Advertising and Third-Party Services

6.1 本服務可能展示第三方廣告(包括開屏、信息流、插屏、激勵視頻、Banner、貼片等)並可能使用基於興趣的個性化廣告技術(例如Cookie或類似技術、廣告識別碼等)。詳見《私隱政策》。

6.2 第三方廣告或連結可能引導您至第三方網站或服務。第三方的產品與服務不受我們控制,其條款及私隱做法由其自行負責。

6.3 我們可能使用第三方支付、雲服務、風控等服務供應商。對於第三方服務造成的延誤或中斷,我們將合理協助,但不對第三方的作為或不作為承擔超出法律要求的責任。

6.1 The Service may display third-party advertisements (including splash, feed, interstitial, rewarded video, banner, pre/mid/post-roll, etc.) and may use interest-based personalized advertising technologies (e.g., cookies or similar technologies, advertising identifiers). See the Privacy Policy for details.

6.2 Third-party ads or links may direct you to third-party websites or services. We do not control third parties; their terms and privacy practices are their own responsibility.

6.3 We may use third-party providers for payment processing, cloud services, risk control and more. We will provide reasonable assistance regarding third-party issues, but we do not assume liability beyond what is required by law for acts or omissions of such third parties.

7. 禁止行為 / Prohibited Conduct

您不得在使用本服務時從事或促成任何下列行為(包括但不限於在本服務內外協助他人從事):

(a)違反任何適用法律法規、法院命令或監管要求;

(b)發布、傳播或儲存非法、誹謗、淫褻、暴力、仇恨、騷擾、歧視、恐嚇、詐騙或其他不當內容;

(c)侵犯他人知識產權、私隱權、人格權或其他合法權益;

(d)未經授權收集、公開或散佈他人個人資料(包括「起底/人肉搜索」等);

(e)干擾或破壞本服務或其伺服器、安全機制;

(f)規避或嘗試規避任何內容保護、付費機制或地區限制;

(g)進行任何未經授權的商業推廣、垃圾訊息或大量騷擾訊息;

(h)使用外掛、作弊程式、機器人、腳本或任何破壞遊戲公平性及正常運作的行為;

我們可視情況採取內容移除、功能限制、暫停/終止帳號、拒絕退款等措施(以法律允許為限)。

You must not engage in or facilitate any of the following (whether inside or outside the Service):

(a) violate any applicable laws, court orders or regulatory requirements;

(b) publish, transmit or store unlawful, defamatory, obscene, violent, hateful, harassing, discriminatory, threatening, fraudulent or otherwise inappropriate content;

(c) infringe intellectual property, privacy, personality rights or other lawful rights of others;

(d) collect, disclose or distribute others’ personal data without authorization (including doxxing);

(e) interfere with or disrupt the Service, its servers or security mechanisms;

(f) circumvent or attempt to circumvent any content protection, payment mechanism or regional restriction;

(g) conduct unauthorized commercial promotions, spam, or mass unsolicited messages;

(h) use cheats, bots, scripts or any tools that undermine fair play or the normal operation of the game;

We may take actions such as content removal, feature restriction, account suspension/termination, and refusal of refunds (to the extent permitted by law).

8. 知識產權 / Intellectual Property

8.1 本服務及其內容(除用戶內容外)之所有權利、所有權及利益(包括著作權、商標權、專利權及商業秘密)歸我們或權利人所有。

8.2 我們授予您一項可撤銷、有限、非獨占、不可轉讓、不可再授權的許可,僅供您依本條款以個人、非商業方式使用本服務。

8.3 未經我們書面同意,您不得複製、改作、逆向工程、抓取、鏡像或以其他方式利用本服務內容。

8.1 All rights, title and interest in and to the Service and its content (excluding User Content) including copyrights, trademarks, patents and trade secrets belong to us or the respective rights holders.

8.2 We grant you a revocable, limited, non-exclusive, non-transferable, non-sublicensable license to use the Service for your personal, non-commercial purposes in accordance with these Terms.

8.3 Without our prior written consent, you may not copy, modify, reverse engineer, scrape, mirror or otherwise exploit the Service or its content.

9. 免責聲明與責任限制 / Disclaimers and Limitation of Liability

9.1 本服務按「現狀」及「可用性」提供。我們不保證本服務不會中斷、無錯誤或完全安全。

9.2 在法律允許最大範圍內,我們不對任何間接、附帶、特殊、懲罰性或後果性損失負責(包括但不限於利潤、商譽、資料或內容損失)。

9.3 任何情況下,我們就本條款及本服務所承擔的總責任,以以下兩者之較高者為上限:(i)您就引致索償之事件發生前3個月內向我們實際支付的費用總額;(ii)HKD 500(或等值貨幣)。惟法律不得排除或限制的責任除外(例如因疏忽導致的人身傷亡、詐騙等)。

9.4 本條款不影響您可能享有的任何不可排除的法定權利。

9.1 The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free or completely secure.

9.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive or consequential losses (including loss of profits, goodwill, data or content).

9.3 In any event, our aggregate liability arising out of or relating to the Service and these Terms will not exceed the greater of: (i) the total fees you actually paid to us in the 3 months preceding the event giving rise to the claim; and (ii) HKD 500 (or equivalent). This does not apply to liabilities that cannot be excluded or limited by law (e.g., death or personal injury caused by negligence, fraud).

9.4 These Terms do not affect any non-excludable statutory rights you may have.

10. 暫停、終止與條款更新 / Suspension, Termination and Updates

10.1 我們可基於安全、合規或技術原因暫停或終止本服務的全部或部分功能,並會在可行情況下作出合理通知。

10.2 若您違反本條款或相關政策/規則,我們可對您採取限制、暫停或終止措施。

10.3 我們可不時更新本文件。更新後版本將於網站或產品介面公佈並自公佈之日起生效(或另行指明生效日)。如屬重大變更,我們將在可行情況下於生效日前不少於7日以更顯著方式通知(例如彈窗提示、首頁公告;如我們持有您的電郵,亦可能以電郵通知)。

10.1 We may suspend or discontinue all or part of the Service for security, compliance or technical reasons, and will provide reasonable notice where practicable.

10.2 If you breach these Terms or related policies/rules, we may restrict, suspend or terminate your access.

10.3 We may update this document from time to time. The updated version will be published on the website or within the product interface and will take effect upon publication (or a specified effective date). If the changes are material, we will, where practicable, provide more prominent notice at least 7 days before the effective date (e.g., pop-up notice, homepage announcement; and if we have your email address, we may also notify you by email).

11. 適用法律與管轄 / Governing Law and Jurisdiction

本條款受香港特別行政區法律管轄並按其解釋。因本條款或本服務引起或與之相關的任何爭議,雙方同意提交香港特別行政區法院專屬管轄。

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
